Abstract

This article examines the doctrine of rebus sic stantibus (fundamentalchange of circumstances) in international law and its relationship with principles ofinternational investment protection, with particular attention to its implications forVietnam. The article analyses the content and conditions for its application underArticle 62 of the 1969 Vienna Convention on the Law of Treaties, as well as itsinteraction with investment protection standards such as fair and equitable treatment,full protection and security, non-discrimination and protection against indirectexpropriation. Drawing on practice in the settlement of international investmentdisputes, the article advances recommendations for Vietnam on how to apply thedoctrine of rebus sic stantibus effectively in managing international investment disputes.Keywords: Rebus sic stantibus; international investment protection; Vietnam;Fundamental change of circumstances; Investment disputes; Bilateral investmenttreaties; Right to regulate.
