Abstract

In the context of increasingly deep and extensive international trade, thedetermination of the jurisdiction of national courts has also evolved. The extension ofthe jurisdiction of the Court is no longer strictly limited by the geographical territory ofthe State but is interpreted and applied to respond to the new context, while stillrespecting the traditional territorial principle. The article examines the experience of theUnited States, in comparison with Vietnamese law, regarding the application of thedoctrine of the “long arm” of the Court in the current context of international trade,thereby putting forward some recommendations to improve Vietnamese law.Keywords: “Long arm” jurisdiction, jurisdiction, US court, Vietnamese court,international trade.
