Abstract

The development of administrative law in the world is often associatedwith the phenomenon of the “administrative-regulatory state”. This topic has not beenthoroughly studied in Vietnamese jurisprudence. This article explores the nature,characteristics, impacts and roles of the administrative-regulatory state phenomenon ina number of countries and legal systems around the world; thereby identifying andassessing the existence and influence of the administrative-regulatory state phenomenonin Vietnam.Keywords: Administrative state, regulatory state, delegated legislation, regulation,discretionary power, administrative due process, administrative justice.
