Abstract

The dispute settlement system of the World Trade Organization (WTO) isfacing its grave crisis, leading to no appeals to be heard by the Appellate Body since2019. In response, WTO members have proposed interim alternative measures; One ofwhich is the arbitration mechanism under Multi-party Interim Appeal ArbitrationArrangement (MPIA) pursuant to Article 25 of the DSU. This article aims to clarifylegal issues of this appellate arbitration under the MPIA, thereby proposingrecommendations for Viet Nam.
