Abstract

When a person requesting notarization is illiterate, the law mandates thepresence of witnesses to ensure that the contract or transaction is concluded in anequitable and transparent manner, and to protect the person’s legitimate interests.However, the legal provisions concerning witnesses are limited and insufficientlydetailed, resulting in significant challenges and complications in notarial practice.This article analyzes the deficiencies and shortcomings in the legal frameworkgoverning witnesses in notarization activities and highlights the professional risks thatnotaries may face as a result. Accordingly, it puts forward proposals and solutions toaddress such risks.Keywords: Witness; Notary; Risk.
