Abstract

A significant change in the 2024 Land Law is the removal of householdsfrom the list of recognized land users in Vietnam. Despite the novelty, it is a necessaryprovision that received considerable support during the drafting process, the continuedrecognition of land use rights for this group is deeply rooted in historical practice. The2024 Land Law effectively addresses this transition, providing flexibility for affectedindividuals to continue exercising their rights. However, certain shortcomings remain,particularly concerning the determination of household members—an issue that is notfully clarified in the 2024 Land Law. In addition to analyzing these remainingchallenges, this article makes proposals to improve the relevant legal framework.
