Abstract

Unemployment insurance was first introduced in the 2006 Law on SocialInsurance, which took effect on 1st January 2009. Over the course of its implementation,various shortcomings have emerged. Consequently, the Amended Draft Law onEmployment has been developed to address these issues. In this article, the authorsprovide an overview of the unemployment insurance regime and examine Taiwan’s andSouth Korea’s experiences with unemployment benefit levels, early reemploymentbenefits, and benefit periods. These insights form the basis for commentary on thecorresponding provisions in the draft Law. By selectively learning from foreign legalpractices, the authors then make proposals to supplement and revise the Amended DraftLaw on Employment.
