Abstract

This article analyzes changes introduced by the 2023 Law on ConsumerProtection concerning the validity of arbitration clauses in disputes between consumersand business entities with a focus on two main issues: (i) the parties entitled to exercisepriority in choosing a dispute resolution method; and (ii) the conditions for applying theprovision on consumers’ priority in selecting a dispute resolution mechanism. Thereby,the authors evaluate how these reforms affect the practical resolution of consumerrelated disputes before commercial arbitration forums.
