Abstract

Politburo Resolution No 57-NQ/TW dated 22 December 2024 ondeveloping science and technology, innovation, and national digital transformationidentifies innovation and digital transformation as key drivers. To institutionalise thisorientation, the 2020 Law on Investment and Law No 90/2025/QH15 amending andsupplementing a number of provisions of the Law on Bidding, the Law on Public–Private Partnerships, the Law on Customs, the Law on Value-Added Tax, the Law onExport and Import Duties, the Law on Public Investment, and the Law on Managementand Use of Public Property (Law No 90/2025/QH15) have expanded the list ofincentivised investment sectors in high technology, big data, artificial intelligence, anddigital human-resources training. On that basis, this article analyses the currentinvestment-law framework, compares international experience, identifies shortcomingsin practice, and recommends solutions to improve the law so as to implementResolution No 57-NQ/TW effectively.Keywords: Law on Investment 2020; Law No 90/2025/QH15; Resolution No 57-NQ/TW; Innovation; Digital transformation; High technology; AI.
