Abstract
Framework laws are an objective and widely observed phenomenon inlegal systems, and most countries’ legal systems recognise some form of frameworklegislation. The enactment of framework laws is motivated, in part, by the aim ofenabling parliaments/national assemblies to avoid deliberating matters that are overlydetailed or highly technical; more importantly, framework laws help to reducelegislative burdens in the law-making process. Politburo Resolution No 66-NQ/TWemphasises the development of framework laws and the delegation of legislativeauthority to administrative bodies to specify details through implementing instruments,thereby ensuring flexibility and responsiveness to the frequent changes of socialrelations. This article surveys the practice of enacting framework laws in selectedcountries, examines the consequences that may arise, and draws lessons for Viet Nam.Keywords: Framework laws; decrees; circulars; National Assembly; Government.Downloads
