Abstract

On 24 November 2015, Vietnam became a party to the 1980 ViennaConvention on Contracts for the International Sale of Goods (CISG), therebyreinforcing Vietnam’s role in the harmonisation of private international law. Focusingon Article 72 CISG—governing the right to terminate a contract in the event ofanticipatory breach—and drawing on decisions by courts and arbitral tribunalsworldwide, this article identifies shortcomings in current Vietnamese law and advancesrecommendations for its improvement.Keywords: 1980 Vienna Convention (CISG); termination of contract; anticipatorybreach.
