Abstract

The State may allocate land to investors for the construction of projectsthat serve the public interest. In practice, however, some developers do not implementtheir projects in accordance with the schedule initially committed. Under the 2024 LandLaw, the State may either extend the developer’s land-use term or directly recover theland without compensating for the land itself or the assets attached to it. Although theseprovisions have been specified more clearly, difficulties persist in application. Thisarticle identifies shortcomings in determining when an extension may be granted,clarifies the scope of force majeure affecting project timelines, and proposes solutions toimprove the law governing land recovery in general and, in particular, recovery inrespect of delayed projects.Keywords: Land recovery; project developer; delayed project; Land Law 2024.
